Deferred Action Lawyers

On June 15, 2012, President Obama announced the new immigration policy of deferred action, which will spare deportation for young, undocumented immigrants who qualify.

To be eligible for the new enforcement rules, a person must have come to the United States under 16 years old and have resided in the country for at least five years. They must be in school, have a GED, have graduated from high school or have been honorably discharged from the U.S. military. They must also not have a significant criminal record.

Deferred action is not a path to a green card. It is a unique designation that provides certain benefits including the possibility of legal employment authorization, but each case is different. Before you apply, it is important to speak to a licensed and experienced immigration attorney because requests for deferred action will be reviewed on a case-by-case basis and not every young immigrant will qualify. Individuals found to be ineligible due to criminal history may be subject to removal or other immigration enforcement action.
